Agreement to Terms

By accessing or using EstateWrap ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

EstateWrap is an estate management application designed to help users organize and track the administrative tasks involved in settling an estate after someone passes away. The Service provides checklists, letter templates, and organizational tools to assist with this process.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SETTLED, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages resulting from reliance on information provided through the Service
  • Any damages resulting from errors, mistakes, or inaccuracies in content
  • Any damages resulting from unauthorized access to or use of our servers

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

User Responsibilities

By using EstateWrap, you agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Use the Service only for lawful purposes and in accordance with these Terms
  • Not use the Service to store or transmit malicious code
  • Not attempt to gain unauthorized access to any part of the Service
  • Not use the Service in any way that could damage, disable, or impair the Service
  • Verify all information and templates with qualified professionals before use

Pricing and Payment

Free Trial

EstateWrap offers a 30-day free trial that provides full access to all features. No credit card is required to start the free trial. At the end of the trial period, you will need to purchase a license to continue using the Service.

One-Time Payment

After the free trial, EstateWrap is available for a one-time payment of $80 USD, which grants you lifetime access to the Service. This is not a subscription - there are no recurring charges.

Payment Processing

All payments are processed securely through our third-party payment processor. By making a purchase, you agree to the payment processor's terms and conditions.

Refund Policy

We want you to be satisfied with EstateWrap. Our refund policy is as follows:

30-Day Money-Back Guarantee

If you are not satisfied with your purchase, you may request a full refund within 30 days of your payment date. No questions asked. To request a refund, please contact us at support@estatewrap.com with your account email and purchase confirmation.

After 30 Days

Refund requests made more than 30 days after purchase will be evaluated on a case-by-case basis. We may offer partial refunds or account credits at our discretion in exceptional circumstances.

Refund Processing

Approved refunds will be processed within 5-10 business days. The refund will be credited to the original payment method used for the purchase.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of EstateWrap and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EstateWrap.

User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By providing User Content, you grant us a limited license to use, store, and display that content solely for the purpose of providing the Service to you.

You are responsible for the accuracy, legality, and appropriateness of all User Content you provide. We do not claim ownership of your personal information or estate data.

Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Upon account termination, we will delete your personal data in accordance with our Privacy Policy, unless retention is required by law.

Indemnification

You agree to defend, indemnify, and hold harmless EstateWrap and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware.

Dispute Resolution

For any dispute you have with EstateWrap, you agree to first contact us and attempt to resolve the dispute informally. If we are unable to resolve the dispute informally, we each agree to resolve any claim, dispute, or controversy through binding arbitration, except that each party retains the right to bring an individual action in small claims court.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
